01Who we are

STATIC ("we", "us", "our") is a mobile application operated by [STATIC App, sole trader, ABN 38 193 415 829], located in South Australia, Australia.

We are an APP entity for the purposes of the Privacy Act 1988 (Cth) and are bound by the Australian Privacy Principles ("APPs").

This Privacy Policy describes how we collect, use, store, disclose and protect your personal information when you use the STATIC app and any related services (collectively, the "Service"). By using STATIC, you agree to the practices described in this Privacy Policy.


02What information we collect

2.1 Information you provide

When you create an account and use STATIC, we collect:

  • Account credentials: email address and password (passwords are stored only by Firebase Authentication, never by us in plain text).
  • Profile information: username, avatar (emoji or photo), bio, vehicle make/model/year/colour/type, account type (Rider, Organiser, Vendor), and optional Instagram handle.
  • Vendor information: store name, tagline, banner image, listings, prices, descriptions, website URLs and any other details you choose to publish.
  • Event content: meets and rides you host (title, description, meeting points, GPS coordinates of geofenced locations, event times, attendee lists).
  • Messages: direct messages you send to other users, including text content and timestamps.
  • User-generated content: images you upload (profile photos, vendor banners, listing images) and any reports, votes, or "leaks" you submit.

2.2 Ride telemetry (when you start tracking)

STATIC includes optional ride-telemetry features. When — and only when — you actively tap "Start Tracking", we collect:

  • GPS location data: latitude, longitude, speed and timestamps, recorded approximately every 10 seconds or every 30 metres.
  • Motion-sensor data: lean angle and pitch angle derived from your device's accelerometer and gyroscope.
  • Session metadata: start time, end time, duration, distance travelled, peak speed, peak lean angle, peak wheelie angle.

Location and motion collection stops the moment you end a ride session. We do not run location tracking in the background outside of an active ride session.

2.3 Device information

  • Device model and operating system version
  • IP address (transiently, via Firebase)
  • App version
  • Crash logs and basic diagnostic data (via Firebase)
  • Approximate timezone

2.4 Geofenced check-ins

If you RSVP to a meet, we may use your device's location to detect whether you have arrived within the host's defined geofence (typically 50–500 metres around the meeting point). This is used to record attendance and unlock voting rights for that meet.

2.5 Sensitive information

We do not knowingly collect sensitive information (as defined in the Privacy Act) such as health information, racial or ethnic origin, political opinions, religious beliefs or sexual orientation.


03How we use your information

We use your information to:

  • Create, maintain and authenticate your account.
  • Display your profile, stats, achievements and reputation to other users.
  • Match you with nearby meets, rides, vendors and other users.
  • Record ride telemetry and update your stats and leaderboard ranking.
  • Enable direct messaging, friend requests, RSVPs, voting and other social features.
  • Send you push notifications about messages, friend requests, reputation changes, and events you've RSVP'd to (you can disable these in your device settings).
  • Operate the Midnight Market vendor marketplace.
  • Detect, investigate and prevent fraud, abuse and violations of our Terms.
  • Improve the Service, fix bugs and develop new features.
  • Comply with legal obligations.

We do not sell your personal information. We do not use your personal information for third-party advertising.


04Who we share your information with

4.1 Other STATIC users

The following is visible to other users: your username, avatar, bio, vehicle, reputation, achievements, ride stats, and Instagram handle; events you host; vendor stores and listings you publish; and messages you send (visible only to the recipient).

4.3 Legal disclosures

We may disclose your information where required by law, court order, or to comply with a subpoena or lawful request from law enforcement; investigate suspected violations; or protect the rights, property or safety of STATIC, our users or the public.

4.4 Business transfers

If STATIC is acquired or merges with another entity, your information may be transferred to the new owner, subject to this Privacy Policy or a successor policy.


05Overseas disclosure

Because we use Google Firebase, your personal information is stored on servers located in the United States and other countries where Google operates data centres. By using STATIC, you acknowledge and consent to this overseas disclosure. We take reasonable steps to ensure overseas recipients handle your information consistently with the APPs.


06How long we keep your information

  • Active account data: retained for as long as your account is active.
  • Ride telemetry sessions: retained until you delete them or your account.
  • Messages: retained on our servers until deleted by you or your account is deleted.
  • Deleted account: when you delete your account, we delete your profile, vendor store, events, goals, RSVPs and friend relationships from our active database. Some residual data may persist in backup snapshots for up to 90 days.
  • Legal holds: where required to comply with a legal obligation, we retain data only as long as necessary.

07Security

We take reasonable steps to protect your information from misuse, interference, loss, unauthorised access, modification or disclosure, including HTTPS/TLS encryption in transit, encryption at rest (provided by Firebase), Firebase Authentication for credential storage, role-based Firestore security rules, and re-authentication required for sensitive actions such as account deletion.

No system is perfectly secure. We cannot guarantee that unauthorised access will never occur.


08Notifiable data breaches

If we suffer a data breach that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner ("OAIC") in accordance with the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act.


09Your rights

Under the Australian Privacy Principles, you have the right to:

  • Access the personal information we hold about you.
  • Correct information that is inaccurate, out of date, incomplete, irrelevant or misleading.
  • Withdraw consent to particular uses (for example, by disabling notifications or revoking location permission via your device settings).
  • Delete your account at any time from within the app (Profile → Danger Zone → Delete Account).
  • Lodge a complaint about how we handle your personal information.

10Permissions on your device

STATIC requests the following iOS permissions. You can grant or revoke these at any time via Settings → STATIC.

  • Location (When In Use / Always): for nearby meets, navigation, geofenced check-ins, and ride telemetry.
  • Motion & Fitness: for lean angle, wheelie angle and acceleration tracking during rides.
  • Photo Library: to let you upload a profile photo, vendor banner or listing image.
  • Notifications: to alert you about friend requests, messages, reputation changes and event updates.

The Service will continue to work with reduced functionality if you decline a permission.


11Children

STATIC is not intended for users under 16 years of age. We do not knowingly collect personal information from anyone under 16. If we become aware that a user is under 16, we will delete the account and any associated information. 12International users

12.1 European Economic Area / United Kingdom (GDPR)

If you are in the EEA or UK, you have additional rights under the General Data Protection Regulation, including rights to data portability, erasure, restriction of processing, and to object to processing. Our legal bases for processing are: (a) performance of our contract with you; (b) your consent (for ride telemetry, notifications and similar optional features); (c) our legitimate interests in operating and improving the Service; and (d) compliance with legal obligations.

12.2 California (CCPA / CPRA)

If you are a California resident, you have the right to know what categories of personal information we collect, to request deletion, and to opt out of any "sale" or "sharing" of personal information. We do not sell personal information.


13Changes to this Policy

We may update this Privacy Policy from time to time. When we do, we will update the "Last Updated" date at the top. If the changes are material, we will notify you in-app or by email before they take effect. Your continued use of STATIC after a change takes effect constitutes acceptance of the updated Policy.
